spain — telefonica freed from network sharing obligation

Spain’s telecoms watchdog, The Telecommunications Market Commission (CMT), has ruled that Telefonica will no longer be forced to allow rivals access to its new fibre optic network, Reuters reports. In May this year the regulator had stated that Telefonica was to grant operators, including Ya.com, access to the network by September 2008. ‘After hearing arguments both from Telefonica and alternative operators, the CMT has withdrawn the obligation for Telefonica to provide wholesale services,’ a CMT spokesman said. Despite the reversal, Telefonica will still have to provide access to its cable ducts for rival operators, as the CMT believes that this will lead to faster completion for alternative networks.
